Sergeant Jim Collins informed the court that GardaĆ stopped the defendant’s black Mitsubishi at Laghey. A subsequent breath test administered at the Garda station returned a reading of 67mcg per 100ml of breath. The legal limit is 22mcg/100ml.
Solicitor Frank Dorrian, representing Mr. Curran, told Judge ĆiteĆ”in Cunningham that his client was a family man who was currently unemployed and came before the court with no previous convictions.
Following the guilty plea, Mr. Dorrian requested a six-month postponement of the driving ban, a request to which Sergeant Collins had no objection.
Judge Cunningham imposed a ā¬200 fine and the mandatory three-year disqualification from holding a driving licence. The driving ban will take effect from March 31 (allowing for the six-month postponement).
